Robert I. Chernett focuses his practice on litigation and
transactional matters regarding real estate including: purchase,
sale and development of commercial property throughout the
United States; private and public mechanics' liens; construction
and business litigation; foreclosure; commercial tax complaints;
and landlord / tenant disputes. Mr. Chernett's clients include:
commercial banks, owners and developers of commercial projects
in Florida, Pennsylvania, Ohio and Massachusetts, franchise
holders of international hotels and restaurants; owners and
developers of shopping centers, industrial office buildings,
housing projects and hotels; landlords, general contractors,
subcontractors and materialmen. In addition Mr. Chernett is
local counsel for out of state law firms for real estate matters
within the State of Ohio.

Real Estate Practice Section; the Cleveland Bar Association, Real Estate Practice Section;

Private Endeavors
Over the past 32 years, I have developed as well as acquired interests in a variety of projects, including commercial and residential properties in Ohio, Florida and North Carolina. These properties include strip centers, hotels, warehouses and residential housing developments.
Case Study
Client: Developer of a hotel having a franchise with
an international hotel chain.
Issue: The General Contractor hired by the Developer
forged waivers of liens and diverted the construction funds
to another project being constructed by the General Contractor. As
a result of the General Contractor’s actions, 27 mechanics’
liens were filed against the hotel development project valued
at $1.6M and an additional $2.5M in unjust enrichment claims.
Solution: Withheld final draw payment from General
Contractor and established an escrow with remaining construction
funds to satisfy all claimants. Challenged the validity of
each of the mechanics' liens filed resulting in 17 liens being
withdrawn as being void and settled remaining mechanics' liens
for approximately $500,000. Resolved unjust enrichment claims
by using the balance of the remaining funds to pay each remaining
unsecured claimant $0.08 on the dollar in return for a full
release.
Result: All mechanics liens have been released from
the project.
