Case Study

Client: Developer of a hotel having a franchise with an international hotel chain.

Issue: The General Contractor hired by the Developer forged waivers of liens and diverted the construction funds to another project being constructed by the General Contractor. As a result of the General Contractor’s actions, 27 mechanics’ liens were filed against the hotel development project valued at $1.6M and an additional $2.5M in unjust enrichment claims.

Solution: Withheld final draw payment from General Contractor and established an escrow with remaining construction funds to satisfy all claimants. Challenged the validity of each of the mechanics' liens filed resulting in 17 liens being withdrawn as being void and settled remaining mechanics' liens for approximately $500,000. Resolved unjust enrichment claims by using the balance of the remaining funds to pay each remaining unsecured claimant $0.08 on the dollar in return for a full release.

Result: All mechanics liens have been released from the project.
