Case Study
Client: Large multi-million dollar non-bank Trust Company.
Issue: Our client does not engage in banking services under
applicable Uniform Commercial Code law yet was named as a defendant
in class action litigation involving various claims brought under
the UCC.
Solution: Implement litigation strategy that actively pursued
dismissal on Civil Rule 11 grounds and successfully negotiated dismissal
of all class claims at nascent stage of class litigation.
Result: The clients rights were vindicated and the
decision to aggressively seek relief under Civil Rule 11 culminated
in an immediate dismissal that saved the client from expending time
and legal fees in protracted litigation.
