  • Represented four large lending institutions in multi-million dollar, multi-district litigation involving recovery rights under claims made on surety bonds, insurance and financial guarantees.

Case Study

Client: Large multi-million dollar non-bank Trust Company.

Issue: Our client does not engage in banking services under applicable Uniform Commercial Code law yet was improperly named as a defendant in class action litigation involving various claims brought against national banks under the UCC.

Solution: Implement litigation strategy that actively pursued dismissal on Civil Rule 11 grounds and successfully negotiated dismissal of all class claims at nascent stage of class litigation.

Result: The client’s rights were vindicated and the decision to aggressively seek relief under Civil Rule 11 culminated in an immediate dismissal that saved the client from expending time and legal fees in protracted litigation.
